Fortitude HP Gym – Membership Cancellation Policy

At Fortitude HP Gym, we are committed to transparency and fairness in managing membership agreements. To ensure clarity and avoid misunderstandings, all cancellations must adhere strictly to the process outlined below.
1. Cancellation Request Procedure
To initiate cancellation of your membership:
You must complete and submit the official Membership Cancellation Form, available on our website or in person at the gym.
Verbal or informal communication (including SMS, social media messages, or informal emails) will not be accepted as valid cancellation notice.
2. Written Confirmation Requirement
Upon receiving your cancellation form, our team will send you a written Confirmation of Cancellation Request via email from team@fortitudehp.com.au.
To complete the cancellation process, you must respond to this confirmation email to verify receipt and your intention to cancel.
If you do not respond within 7 calendar days of the confirmation being sent, your membership will remain active, and you will continue to be charged accordingly.
It is the member’s responsibility to ensure timely communication and confirmation.
3. Effective Cancellation Date
Your membership will be considered cancelled from the date we receive your completed form and your confirmation reply, whichever is later.
Membership charges will apply up to and including the effective cancellation date.
Retrospective cancellations (requests to cancel memberships in the past) are not permitted under this policy.
4. Refunds
Where applicable, the maximum refund available upon successful cancellation is $150 for unused portions of prepaid membership fees.
Refunds will not be granted for periods of non-use unless cancellation was formally processed.
Refunds will be issued within 14 business days of receiving full cancellation confirmation.
5. Membership Adjustments (e.g. Downgrades to Low Usage or Upgrades)
Requests to alter membership type (e.g. downgrade to low-usage plans or upgrades) must be made in writing and confirmed by our team via email.
Changes will only take effect after written confirmation is received from Fortitude HP Gym.
Non-responses, unclear communication, or failure to complete the required form will result in the existing membership continuing unchanged.
6. Consumer Law Compliance
This policy is designed to be consistent with your rights under the Australian Consumer Law (ACL) and Fair Trading Act 1987 (NSW). It does not limit or exclude any rights or remedies you may have under these laws. If you believe you are entitled to a remedy under the ACL, please contact our team to discuss your situation.
